No To Poverty is a non-profit organisation, incorporated in the Republic of Mauritius (NGO Registration No: 16378), operating under the domain name www.notopoverty.org

We provide this website and the service(s) herein subject to these Terms of Service; Privacy Policy; and Copyright Policy (the “Policies”).

By using the Services provided on this website, you acknowledge and agree to the ‘No To Poverty’ Terms of Use and the Policies; and if you are using the Services on behalf of a business entity, then you acknowledge and agree to the No To Poverty Terms of Use and the Policies on behalf of the business entity. If you do not agree with the Policies, then do not use the Services. You may not use the Services if we have restricted or terminated your use of the Services

We reserve the right to modify, change, add, remove or discontinue any portions of the Policies, at any time without any prior written notice to You. It is Your responsibility to review these Policies periodically for updates. Your continued use after we have updated and posted the Policies constitutes consent to the amendment(s) by you and your business entity, if applicable. If you do not agree to the amendment(s), then do not continue using the Services.

What is the purpose of this website?
We maintain this website to:

Provide you with information about our Activities;
Operate an online shop for the funding of our activities;
Promote awareness campaign and support
Use of the Services.
Provision

We will use reasonable efforts to ensure the Services are up and running, but we are not liable for any disruption of services not under our control. We shall hold no responsibility, liability for any actions, acts including but not limited to errors, transmission, activities and issues arising out of internet connectivity and any other network related issues. If you use links provided on our website pointing to other websites and services, you do so at your own risk. We are not responsible for such other sites or services.

Prohibited uses
You may not use the Services to perform fundraising for other organisations.

You may not do anything through the Services that is illegal or that diminishes the purposes of our organisation or that will harm the Services, including using bots or other automated systems.

Accounts and social media
If you register as a User, we may request information about you as provided in our Privacy Policy and certain information about you may be discoverable to other users. You shall keep your account Username and Password secure and do not share it with anyone as You are responsible for everything that happens through your account. We may close your account at any time for any reason.

No To Poverty will use reasonable efforts to notify you in advance if we desire to use your content on our forums such as but not limited to FaceBook page and blogs; however, the license you have granted to us gives us the right to use it without such notice. Unfortunately, due to the nature of the Internet, we cannot guarantee that other users of the website or Services that have access to the content you share will not use such content in a way that might violate your rights and we disclaim all liability for such uses by other users.

Your termination of your use of the website and/or the Services, or any portion thereof, does not terminate the above-described license. Further, you may request that we remove your content from our systems but we may not be able to do so, and we are not obligated to do so. We also have no obligation to retain any of your content.

Forums / Posts
If this Site contains bulletin boards, chat rooms and / or blog page (“Forums”), the User agrees to use the Forums only to send and receive messages and materials that are proper and related to the particular Forum. If you access the Forum then additional information about you, including content you supply, may be discoverable to other users. We may terminate your access to the Forum at any time for any reason. The following Terms, for the benefits of all, are applicable to posts, comments and reviews posted by You on our Forum and if you do not agree to these Terms, do not use the forum. You specifically agree not to post or transmit any comments, reviews, posts, content or engage in any activity that:

  • Is in any other languages rather than English, French and Mauritian Creole;
  • Is Harmful, Abusive, Vulgar, Harassing, Threatening, Profane, Indecent, Defamatory, Discriminatory, Obscene, Libellous, Hateful Or Immoral;
  • Contains any negative racial or religious nature or abusive language (no name-calling, no foul language, etc.);
  • Shall reveal, transmit, share or otherwise communicate any personal information and not to post anyone’s email address without their prior consent (our staff members, other users, etc.);
  • Contravenes any right, including, such as but not limited to Trademark, Patent, Copyright, Trade Secret, or any other Intellectual Property or Proprietary Rights;
  • Advertise or offer to sell any goods or services, or conduct or forward surveys, contests or chain letters

In addition:
Your comments may be edited by us to protect the privacy and dignity of our beneficiaries and supporters;
You shall not publish, post, distribute or disseminate any defamatory, infringing, obscene, indecent or unlawful material or information;
You shall not upload or attach files that contain viruses, corrupted files or any other similar software or programs that may damage the operation of another’s computer;
You may upload your own photographs but you shall adhere to strict guidelines regarding decency;
You shall not upload any photos or content that is illegal or immoral;
If you have any doubt about whether something should be posted, contact us before posting it;
You shall not use the Services for fundraising or soliciting for other organisations;
You shall not Disguise or attempt to disguise the origin of your comment, review, posts, content such as use of a fake or false name;
You accept full responsibility for any post including photos or contents you submitted.
You acknowledge that all Forums and discussion groups are public and not private communications. Further, the User acknowledges that chats, postings, conferences, e-mails and other communications by other Users are not endorsed by No To Poverty, and that such communications shall not be considered to have been reviewed, screened or approved by No To Poverty.
You agree that repeated violations of these terms may result in immediate account termination and the user to be blocked from our website.

Caution:
The posting and sharing of any videos, photos, films or similar materials taken during our Activities is not authorised without prior written permission from No To Poverty, so as to protect the dignity of our Beneficiaries and of our Donors and Volunteers if they have opted to keep their identity anonymous.

These materials may be used only to promote No To Poverty Programs.

We may offer an online shop on this website, which shall be governed by these terms.

The profit of all products will be used to deliver our activities
All buyers shall be over 18 years old
After you select your order, you will be re-directed to the Regulated Secure Payment Gateway, you shall supply the required info to process your payments.
Prior to effecting any payment you shall read and agree to the respective terms and conditions which are displayed on the website before proceeding to the check out.

No To Poverty reserves its exclusive right in its sole discretion to alter, limit or discontinue the Site or any Materials in any respect. No To Poverty shall have no obligation to take the needs of any User into consideration in connection therewith.

No To Poverty reserves the right to deny in its sole discretion any user access to this Site or any portion thereof without notice.

No waiver by No To Poverty of any provision of these Terms and Conditions shall be binding except as set forth in writing and signed by its duly authorized representative.

Donations
Certain Site Features may allow the Users to make donations in support of NO TOPOVERTY, its projects and activities using a number of different means including credit cards, debit cards and other payment methods.

Currency displayed on NO TO POVERTY website is in USD ($). Payments are processed in MUR. Conversion rate applicable: USD 1.00 rounded to MUR 40.00.

Payment system
NO TO POVERTY uses Appletree (Mauritius) Ltd, a PCI DSS compliant Service Provider Level 1 secure online payment system. Donations can only be made with a valid debit/credit card. Appletree (Mauritius) Ltd guarantees a high level protection when processing your credit card details. Any sensitive authentication data regarding the latter is not stored post processing and not accessible to third parties and NO TO POVERTY. The order confirmed by the client will be considered valid only after the payment transaction has been approved after processing. If a payment transaction is declined, the order will automatically be cancelled and the client will be informed by email. If you do not want to use our payment system or do not own a debit / credit card, you can always contact us directly to discuss alternative payment methods.

By providing information related to a Payment Method, the User represents, acknowledges and agrees that the User: (i) is permitted to use that Payment Method; and (ii) shall be the sole responsible for any fee charged by the User’s financial institution or other payment method provider. When the User makes a donation, the User authorizes NO TOPOVERTY (and its designated payment processor) to collect, process and store information related to the relevant Payment Method and other related transaction information to conduct the transaction and help better manage donors and donations.

We take every reasonable care to ensure that all donations and related transactions are conducted via a secure link. However, the security of information and payments transmitted via the internet cannot be guaranteed. The User acknowledges and agrees that: (i) donations to NTP are at User’s own discretion and risk; and (ii) NTP has no liability whatsoever for (a) any loss the User may suffer if a third party obtains unauthorized access to any information provided by the User and (b) any act or omission by the User’s financial institution, credit, debit card or other payment method provider, telecommunications services providers or any third party in connection with the donations to NTP and transactions related thereto.

Automated Recurring Donation
If your support is for a recurrent monthly payment, you shall set up the standing order with your financial institution if the payment is not by debit or credit card. Email us for our bank details on info@notopoverty.org

Automated Recurring Donation Cancellation
Ongoing support is important to enabling projects to continue their work, so we encourage donors to continue to contribute to projects over time. But if you must cancel your recurring donation, please notify us immediately.

Donation Refund Policy
As part of your rights, you are entitled to a refund from your bank under the terms and conditions of your agreement with your bank. You may request these conditions directly from your bank. “A donation to a charitable organization is considered an irrevocable gift, hence is non-refundable”.

Refunds are returned using the original method of payment.

We are grateful for your donation and support of our organization.

Termination
You may only terminate this agreement with us by suspending your use of the website and Services and delivering written notice to us of your termination. However, you will remain liable for any damage you caused or may later cause to us, the website or the Services.

We may terminate this agreement with you, or any portion thereof, or any access to the website or Services or any portion thereof, for any reason or no reason, at any time, with or without notice to you. Such termination may be immediate or may be at a future date. We may also restrict or prohibit future use of the website and Services by you.

Upon termination of this Agreement, you shall immediately cease using the website and the Services.
